Bidding process for contract works
in
Madhya Pradesh Water Resources Department.
A number of irrigation projects are under construction in State of Madhya Pradesh. Some of the projects are externally aided while other projects are under central assistance in AIBP or funded by NABARD. Works on these projects are being executed by calling bids. Acceptance of bids below the amount of Rs. 100 lakhs is within the power of Chief Engineer/ Superintending Engineer/ Executive Engineer, from Rs. 100 lakhs to 150 lakhs within the power of Engineer in Chief and above Rs. 150 lakhs are sanctioned by Govt. Works costing above Rs. 25 lakh and upto Rs. 60 lakh are invited with post qualification and above Rs. 60 lakh with pre qualification. Wide publicity is made for each bid by publishing the short Notice Inviting Tender (NIT) in various newspapers at the State level and National level. However conditions for bidding process are as follows:
Bidding forms:
2.0 Bids are invited by Water Resources Department either in Local Competitive Bidding (LCB) document or in Item Rate Form-B as provided in Madhya Pradesh Works Department Manual. LCB form is generally used for externally aided projects and Form - B is used for other projects.
Registration of prospective bidders:
3.0 Only bidders registered in appropriate class of registration in Water Resources Department of Government of Madhya Pradesh, as per details given below, are eligible to submit the bids: -

Bidders registered with Government Departments of Madhya Pradesh or with any other state government, or central government / government undertaking or firms of repute are also eligible to bid if they are permitted by the Competent Authority of M.P. Water Resources Department to register themselves in the appropriate class.
Bidding by unregistered contractors:
4.0 If the offer of any unregistered bidder is found acceptable, he has to get himself registered in M.P.W.R.D., in the appropriate class within 30 days from the date of submission of bid or before acceptance of the bid whichever is earlier. Failing to do so, their bids shall be rejected and earnest money shall be forfeited.
Bidding process for pre-qualification bids:
5.0 In bids, where pre-qualification of bidder is necessary, bids will be received in three envelopes.
Envelope 'A' will contain copy of the valid registration or permission from the Competent Authority, earnest money in proper form, attested copies of Income Tax clearance certificate for the previous year.
Envelope 'B' will contain all relevant details pertaining to the physical and financial experience of the bidder for similar type of works proportional to the size of the work and as per criteria fixed for pre-qualification of the bidders which has been mentioned in pre-qualification document.
Envelope 'C' will contain the document pertaining to the financial bids.
Bidders are advised to read the pre-qualification criteria carefully before submission of the bids.
All the three envelopes, A, B, C wilt be put in an outer sealed envelope and shall superscripted as bid for construction of the particular work with name and address of the bidder.
The bids will be opened on the prescribed date and time as mentioned in the short NIT published in the newspapers. The concerned officer or his authorised representative will open the outer envelope. Afterwards, envelope. A will be opened and if the document of this envelop are found valid, then the envelope 'B' will be opened on the same day in the presence of the bidders or their authorised representative who are present. Envelope "C' shall be kept in the safe custody with the concerned officer.
Bidders will be pre-qualified on the basis of information furnished by them in the Envelope 'B' and as per criteria given in the relevant clause of the pre-qualification document. Only pre qualified bidders will be intimated the date of the opening of envelope "C". Envelope 'C' of qualified bidders, shall be opened on the pre-intimated date prescribed by the officer, who is competent to sanction the bid (by C.E. in case of Govt.) in the presence of the bidders or their authorised representatives who choose to be present.
The price bid of the non-qualified bidders will not be opened and will be kept in the concerned office.
Bids not requiring pre-qualification:
6.0 For bids without pre-qualification, only envelope 'A' & 'C' will be submitted which will be opened on the same day as notified in short N.I.T. Envelop 'C' will be opened only if the document of envelope "A" are found valid. In case of Tenders with post qualification, post qualification details are to be kept in envelope "C".
Withdrawal of bids:
7.0 In the event of withdrawal of the offer by the bidder before expiry of the period of validity of offer as mentioned in the bid document or failing to execute the contract agreement, the earnest money shall be forfeited. In addition to this, such bidders shall not be entitled to put their bid for the particular work in case of recall Bid must be submitted in duplicate with one copy marked as original in the cover page. This copy will be govern when there are discrepancies between the two.
Earnest money:
8.0 The Earnest Money to be submitted with the bid will be as follows: -

Where the amount of earnest money to be deposited is more than Rs. 500 and the bidder proposes the pay it in cash the amount should be deposited in the treasury/ State Bank of India and challan should be enclosed with the tender. If however the bidder wishes to deposit the earnest money in any one of the following forms, he may do so and produce duly hypothecated to the Executive Engineer.
9. Conditional bids are liable to be rejected.
10. A pre-bid conference open to all bidders will be held for works pertaining to LCB format on the pre-intimated date. Where in the participating bidders will have an opportunity to obtain clarifications regarding the work and bid conditions as prescribed in the document.
11. In case of unbalanced bids, additional performance security will be taken for the rates which are abnormally below than the estimated rates and for items where rates are abnormally on higher side as compared to the estimated rates, payment will be made at estimated rates plus/ minus over all percentage of the accepted bid till the completion of the work.
